Terms of Service
Last updated: 22 October 2026
1. Who we are and what these Terms cover
These Terms of Service ("Terms") are an agreement between you and Themeasy ("Themeasy", "we", "us"), the business identified in section 17 of our Privacy Policy. They govern your use of:
- the website themeasy.co (the "Site");
- the Themeasy Hub at hub.themeasy.co, where you manage your account, licenses, downloads and support (the "Hub");
- the Themeasy template library, at library.themeasy.co and through its service at cms.themeasy.co, which the Themeasy plugin calls from the Elementor editor (the "Library");
- the Themeasy software: the Themeasy plugin, including its free edition Themeasy Lite, and the Themeasy themes (the "Software").
Together, these are the "Services". By using a Service, or by buying or activating a plan or a license, you agree to these Terms. If you use the Services for an organization, you accept these Terms on its behalf and confirm that you can bind it. You must be of legal age to enter into a contract where you live. If you do not agree, do not use the Services.
2. The software license (GPL)
The Software is free software: its code is licensed under the GNU General Public License, version 2 or later (the "GPL"). The third-party libraries it bundles keep their own licenses, listed in each product's readme. Nothing in these Terms limits the rights the GPL gives you over the code you have received.
A paid plan or license does not change that. What it gives you is access to the services around the Software: the premium downloads and their updates, the activation of the paid features, the cloud Library and support, as described in sections 4 to 6 and 10. The Themeasy name, logo and other brand assets are not licensed under the GPL (section 13).
3. Themeasy Lite and other free products
Themeasy Lite, and any free Themeasy theme, is distributed free of charge on WordPress.org, and you can use it without an account or a license. Free products come without support commitments, and the terms of WordPress.org also apply to what you download from it.
4. Paid plans (subscriptions)
The paid plans of the Themeasy plugin (currently Widgets, Pro and Agency) are subscriptions. What each plan includes is described on themeasy.co/pricing when you buy it; some features also need a Themeasy theme to work, as described there.
- Billing and renewal. A subscription is paid in advance for its billing period (currently one year) and renews automatically at the end of each period until you cancel it. Freemius charges each renewal under the terms of your purchase (section 8). If the price of a renewal is ever going to change, you will be told in advance, so you can cancel before it does.
- Free trials. When a plan offers a free trial, you need a payment method to start it. Unless you cancel before the trial ends, the subscription starts and its first period is charged when the trial ends.
- Cancellation. You can cancel at any time in the Freemius customer portal, which the Hub links to. Cancelling stops the next renewal; the plan stays active until the end of the period you have paid for.
- Sites. A plan covers an unlimited number of sites, your own or your clients', unless the plan says otherwise.
- When a subscription ends. The paid features stop working on every site that used the license, and so do updates, access to the cloud Library and support. Content built with paid features, such as pages that use premium widgets, may no longer display as designed until you renew or replace those features. Templates you inserted while your plan was active stay licensed for those sites (section 6).
5. Theme licenses (one-time purchases)
A single Themeasy theme can be bought with a one-time payment, directly on themeasy.co or on ThemeForest.
- Direct purchase. The license covers one theme on one site and does not expire: the theme, and the Themeasy plugin features that come with it, keep working. Updates and support are included for the period stated on the product page when you buy, and you can extend them by contacting support. The theme's own template library ships with it and works offline; the cloud Library, the rest of the theme catalog and additional sites need a subscription.
- ThemeForest purchase. ThemeForest is part of Envato Market. Envato runs the marketplace and its checkout, and you license the theme from us under the Envato Market license you choose (Regular or Extended). That license and the Envato Market terms, including Envato's item support and refund rules, govern the purchase. The Hub can verify your purchase code to give you downloads, updates and support within that license. When you activate the theme from its setup wizard and agree to it, we create your Hub account and register a license for your site with Freemius, using the name and email address you provide (see our Privacy Policy).
6. The Library and its templates
Library templates are design content that you insert into your site through the Themeasy plugin. Free templates are available to everyone; the cloud Library requires an active plan that includes it.
- You may use the templates you insert to build websites for yourself or for clients, including commercial ones, and you may modify them. A template stays licensed for the website it was inserted into, even after your plan ends.
- You may not redistribute, resell or sublicense the templates themselves — for example as templates, kits or themes, or as part of another template library or marketplace — and you may not download the Library in bulk or by automated means.
- Some templates contain sample images. Unless we say otherwise, they are placeholders for previews and layout: replace them with images you have the right to use. Sample images may be served from our servers, and we may change or remove them at any time, so do not rely on them on a live site.
- We add, change and remove templates over time and do not guarantee that a given template stays available.
7. Accounts and license keys
Some Services need a Hub account. Give accurate information, keep your password and your license keys confidential, and tell us promptly if you notice unauthorized use. You are responsible for what happens under your account. A license key belongs to the account that bought it: do not share or publish it.
We may suspend an account, or deactivate a license key, that breaches these Terms or puts the Services or other users at risk. We will tell you why, unless the law or a security reason prevents it.
8. Payments, invoices and taxes (Freemius as merchant of record)
Prices are shown on the Site and at checkout. Direct purchases, meaning the plans and theme licenses you buy from themeasy.co, are sold by Freemius, Inc. ("Freemius"), a United States company that acts as our authorized reseller and merchant of record. Freemius is the seller of record of your purchase, which means that it:
- runs the checkout and charges your payment method, so the charge on your statement may carry its name;
- calculates, collects and remits the sales tax, VAT or similar taxes that apply to your purchase;
- issues your invoice or receipt; and
- processes renewals, cancellations, refunds and payment disputes.
Your purchase is made under the agreement you accept with Freemius at checkout, together with the Freemius Terms of Service and Privacy Policy. If that agreement and these Terms differ on the payment, the taxes or the invoicing of a purchase, the Freemius agreement applies. These Terms apply to everything else about the Services.
We remain responsible for the products themselves: we develop and deliver the Software and the Services, and we provide support (section 10). We never receive or store your full payment details.
ThemeForest purchases are made on Envato Market, where Envato runs the checkout, collects the payment and any taxes, and issues the invoice under its own terms (section 5).
9. Refunds
Direct purchases come with a 7-day money-back guarantee for technical problems: if, within 7 days of the purchase, the product has a bug or malfunction that our support cannot fix, you receive a full refund. The guarantee is not a trial period; to try the product first, use Themeasy Lite or a free trial where one is offered. We assess each request under this policy, and Freemius, as the seller, returns the money to the payment method you used. ThemeForest purchases follow the Envato Market refund rules.
This section does not limit any right you have under consumer protection law that cannot be waived, such as a statutory right of withdrawal under the laws of the country where you live.
10. Support
Support is provided through the help desk of the Hub, for the products and the period your plan or license includes. We aim to answer promptly but do not guarantee response or resolution times. Support covers the use of our products as documented; it does not cover custom development, third-party plugins or themes, or hosting problems.
11. The Agency plan and white label
The Agency plan lets you replace the Themeasy name and logo with your own brand in the plugin's admin screens and in the Elementor editor, as described on the pricing page, and present those screens under your brand to your clients. You may not remove the copyright and license notices in the code, claim that you developed the Software, or resell or redistribute our downloads, license keys or Library access as a product of your own.
12. Acceptable use
You agree not to:
- disrupt, overload or probe the security of the Services;
- access the Services through unauthorized means, or use another person's account or license key;
- get around the license checks or the usage limits of the Hub or the Library;
- scrape the Services abusively; or
- use the Services for anything unlawful or that infringes the rights of others.
13. Intellectual property
Apart from the Software code, which the GPL covers, the Services and their content — including the Site, the documentation, the templates and the design assets — belong to Themeasy or its licensors. "Themeasy" and the Themeasy logo are our trademarks. WordPress, Elementor, WooCommerce, Envato, ThemeForest and Freemius are trademarks of their respective owners, used here only to identify their products.
Your content stays yours. What you send us, such as support messages, is used only to provide the Services, as described in our Privacy Policy.
14. Third-party products and services
The Software runs on WordPress and Elementor and can work with other third-party products, such as WooCommerce. They are not ours, they are governed by their own terms, and they can change in ways that affect our products. We make reasonable efforts to keep our products compatible but cannot guarantee it. The same applies to the external services the Software and the Services connect to, which are listed in our Privacy Policy and in each product's readme.
15. Changes to the Services
We keep improving the Services and may add, change or remove features. If we remove a significant feature of a paid plan during a billing period you have paid for, we will tell you in advance, and you may cancel and receive a refund for the unused part of that period.
16. Disclaimer of warranties
Except as these Terms expressly state, the Services are provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Services will be uninterrupted or free of errors.
The GPL also provides the Software without warranty. Keep backups of your sites before you install or update any software.
17. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total liability for any claim related to the Services is limited to the greater of the amount you paid for the Service concerned in the 12 months before the event that gave rise to the claim, and USD 100.
Nothing in these Terms limits liability that the law does not allow to be limited, such as liability for fraud or wilful misconduct, or the rights that the mandatory consumer laws of the country where you live give you.
18. Termination
You can stop using the Services at any time, cancel your subscription (section 4) and delete your Hub account in its settings. We may suspend or end your access as described in section 7. The provisions that by their nature should outlast termination — including the license to the templates you inserted and sections 13, 16, 17, 19 and 21 — continue to apply.
19. Governing law and disputes
Talk to us first. If something goes wrong, email hello@themeasy.co. Most issues are solved faster that way, and you and we agree to try to settle a dispute informally for 30 days before taking it to court.
Governing law. These Terms, and any dispute about them or about the Services, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Courts. The state and federal courts located in the State of Delaware have exclusive jurisdiction over those disputes, and you and we accept their jurisdiction. Either of us may still ask any competent court, at any time, for urgent relief to protect its intellectual property or the security of the Services.
If you are a consumer. Nothing in this section takes away the protection that the mandatory laws of the country where you live give you, or your right to bring a claim before the courts of that country when its law gives you that right, as it does in the European Union and the United Kingdom.
Individual claims. To the extent the law allows, you and we may bring claims against each other only on an individual basis, not as part of a class or representative action, and each of us waives the right to a jury trial.
Purchases. Claims against Freemius or Envato about a purchase follow the dispute terms of your agreement with them (sections 5 and 8).
20. Changes to these Terms
We may update these Terms. If a change is material, we will tell you by email or in the Hub at least 30 days before it takes effect. If you do not agree, you can stop using the Services and cancel your subscription before then; if you keep using them, the updated Terms apply. The date at the top shows the current version.
21. General
These Terms are the whole agreement between you and us about the Services, alongside the purchase agreement described in section 8. If a court finds part of these Terms unenforceable, the rest stays in effect. If we do not enforce a provision, we have not waived it. We may transfer our rights and obligations under these Terms to a business that takes over the Services, for example in a reorganization or a sale, and we will tell you if we do.
22. Contact
Questions about these Terms? Email hello@themeasy.co. The business that operates Themeasy is identified in section 17 of our Privacy Policy.
